Elements of alimony in Mississippi

Your decision to end your marriage in Hazlehurst no doubt took a great deal of courage, especially if you were not the primary income earner in your home. While you now can look forward to not having to deal with the stresses that had developed in your marriage, you do have to consider how you will support yourself (and your children, if you have any). Before you begin to plan on spousal support, it may be best to know first if you are even entitled to it. 

According to The Mississippi Bar, the court considers a number of different factors when determining when to reward alimony. These include: 

  • Yours and your ex-spouse's current income and earning capacity 
  • Yours and your ex-spouse's health
  • Yours and your children's needs
  • Your ex-spouse's necessary living expenses 
  • Yours and your ex-spouse's current tax obligations

Any financial or career-related sacrifice you made to either stay at home with your children or to help get your ex-spouse through school may also be taken into account. 

While the circumstances surrounding the end of your marriage may also come into play when determining a reward for alimony, spousal support payments are generally not viewed as being punitive. Rather, they are meant to help you enjoy the same standard of living you did while married while you work to secure your own gainful employment. To do this, the court may decide to award you periodic alimony payments for a predetermined period of time, or a single lump-sum payment.
